Rules of amateur and sports fisheries (Rules of fishing in Ukraine 2016, hereinafter - Fisheries Rules) Developed in accordance with the Law of Ukraine "On the Animal World" (3041-12) and the procedure for the implementation of amateur and sports fisheries, approved by the Decree of the Cabinet of Ministers of Ukraine of July 18 1998 N 1126 (1126-98-P), and regulate the norms of fishing, prohibited places, the duration of the ban of catching water living resources, minimum size Fish and other water living resources, the conditions for conducting sports competitions for fisheries and underwater hunting, area of \u200b\u200baction, permitted and prohibited tools and methods of fishing, etc.

District of Fisheries Rules

The action of these Rules of Fisheries applies to all water bodies of Ukraine (hereinafter referred to as the reservoirs) and their petition system within which it reaches at maximum floods (with the exception of water bodies that are located in the territory of the natural and protected fund, fishing farms, reservoirs that have restrictions in Communication with special use (drinking, technical, etc.), artificially created isolated reservoirs or their sites, on which fishing of water living resources is prohibited).

• Azov;

The Azov region includes:

Definition of terms

Terms that contain these Rules fishing in Ukraine 2016 have the following meaning:

• water bodies - formed by nature or created artificial objects of the landscape or geological structures, where the water (river, lake, sea, reservoir, canal, aquifer) are focused;
• inland reservoirs - lakes, rivers and their petition systems, reservoirs, ponds, channels, as well as technical water bodies;
• plicit reservoir systems - non-flowing water: straits, mouths, lakes and other reservoirs, including those that are temporarily poured with water during the spring reins;
• fisheries water bodies - water bodies that are used or can be used for growing and catching water living resources or matter to reproduce their reserves;
• fisheries water reservoirs common use - water bodies on which amateur and sports fisheries are carried out under the conditions of general use of water living resources without providing special permits for their use and without consolidation of these water bodies for individuals;
• fisheries special use reservoirs - water bodies on which amateur and sports fisheries are carried out on the terms of providing a special permit for the use of water living resources and with fixing (or without such) water facilities for individuals;
• water living resources are a totality of aquatic organisms whose life is impossible without staying in water. These include:
• freshwater, marine, anadromic fish at all stages of development;
• headhead;
• marine mammals;
• water invertebrates, including mollusks, cephalopod, buchelogium, bivalves;
• crustaceans, worms, iglinders, sponges, intestinal, terrestrial invertebrates in the aqueous stage of development, other aquatic animals;
• algae, higher aquatic plants;
• special use of water living resources - all types of use of water living resources (with the exception of amateur and sports fisheries in water bodies (their sections) of common use) carried out with their withdrawal from the natural environment;
• amateur and sports fisheries - fishing, the extraction of water invertebrates in specially defined water bodies (their sites) for personal consumption (subject to the established fishery and water use rules);
• industrial fishing is the type of special use of water living resources that are in a state of natural freedom, by their withdrawal (catch, production, collection) from the natural environment in order to meet the needs of the population and the national economy;
• users of water living resources - enterprises, institutions and organizations regardless of ownership forms, as well as citizens of Ukraine, foreigners and stateless persons who use water living resources;
• permission for the right to implement amateur and sports fisheries - a document issued for the FISH bodies for the right to implement amateur and sports fisheries under the conditions of special use of water living resources on the reservoirs specifically allocated for this purpose (their sites);
• natural and protected fund - Sushi and water space, natural complexes and objects of which have a special environmental, scientific, aesthetic, recreational and other value and are protected as a national heritage regarding which it is established special regime protection, reproduction and use;
• coastal protective strip - part of the water-protection zone of the corresponding width along the river, the sea, around the reservoirs on which the more rigorous mode is installed economic activitythan on the rest of the territory of the water-protection zone;
• pollutants - substance causing water quality deterioration;
• small vessels - plaquinity, not subject to supervision of the classification society of the shipowner;

• water transboundary - water objects located on the border or cross the boundaries of at least two countries;

General provisions

Amateur and sports fish and water invertebrates for own needs All citizens of Ukraine, foreigners, as well as state-owned persons in all reservoirs of Ukraine, with the exception of the catch in the water bodies of the naturally protected fund, pond and other fish farms, water bodies, whose special use is limited (drinking, technical, therapeutic and other), water bodies Where fishing or mining is prohibited by real fishery rules.

Amateur fishing on separate water bodies or their sites (hereinafter referred to as reservoirs) in places of concentration (clusters) of fish, water invertebrates are carried out on the principles of their special use on special solutions of fishewed organs.

Ponds and conditions for the use of water living resources for amateur fishing are determined by fishewing bodies on the basis of scientific and biological justifications.

On separate water bodies, where research organizations do not conduct research, reasonable proposals for determining water bodies for amateur fishing are entered by the ichthiological services of fishewing bodies.

Permits for the right to implement amateur fisheries based on special use of water living resources are issued by fishewed bodies.

For the issuance of permits, the fee is charged, the size of which is established by Ukrgosrybhoz in coordination with the Ministry of Finance.

Standards for fishing fees in the order of special use of water living resources are established by the Cabinet of Ministers of Ukraine.

Ponds can be provided in accordance with the procedure established by law to public organizations for the implementation of amateur fisheries in the contractual principles.

Public organizations, uniting citizens, are engaged in amateur fishing, operate on the basis of their charters (provisions), these rules of fisheries and in accordance with the legislation of Ukraine.

To create favorable the conditions of amateur fisheries and the provision of relevant services to fishermen-lovers on insulated water bodies local significance Or areas of such water bodies can be created in the established legislation, cultural fisheries (hereinafter - CRH). Such farms are created in coordination with fishewing authorities. Mode of amateur fisheries in the Crhus is installed by users of these farms. Rules of fisheries on CRH reservoirs do not apply. The size of the fishing fees in the Crhus is set by users of these farms. Users (founders) CRH can be physical or legal entities of all forms of ownership.

In the water bodies defined for amateur fishing, industrial fishing is prohibited. Catching these water living resources is carried out constantly or temporarily in the order of their special use.

Objects of amateur fishing can be any kinds of fish and water invertebrates, with the exception of species whose catch prohibits these rules for fishing in Ukraine.

Citizens who are engaged in amateur fishing are required:

• fulfill the requirements of these fishery rules;
• maintain the proper sanitary condition of the reservoirs, not to leave on the shores of water bodies and on ice garbage and other waste, not allowing clogging and contamination of water bodies in a different way;
• have documents to have documents giving the right to fishing on separate water bodies where fishing in permissions has been introduced and to present them to employees of fishers or other authorized bodies on their request;
• do not allow damage to pointers, shields and other signs installed on water bodies and on their shores.

Forbidden:

• apply without solving the organs of fishers, new tools and methods of fishing, not provided for by these fishery rules;
• it is located on a reservoir or near him with explosive and poisonous substances, as well as with fish guns, the use of which is currently forbidden to be prohibited in this place, as well as to maintain the prohibited weapons of fishing on water bodies or near them;
• sale by individuals and legal entities that do not have permits, network materials, tools and devices to them, the use of which is prohibited by the rules of fisheries;
• sale or purchase of fish, caviar and water invertebrates and products of their processing without a document confirming the legality of their acquisition, and a quality certificate;
• washing in fishery water bodies or in their coastal stripes vehicle, as well as work, negatively affect the condition of water bodies;
• stopping plastered in missing places for fisheries, except for stopping near settlements and cases of course need (storm, fog, accident, etc.);
• organization of fisheries competitions during the spawning period of fish;
• movement of motor vehicles, except for those belonging to environmental and law enforcement agencies, on the ice of fisheries water reservoirs during the period of the decoration (with the exception of specially equipped ice trails);
• the movement of the flooders in the zones prohibited for fisheries (with the exception of installed ship moves), and in areas declared by the fishests by spawning rates during spawning - all floating funds, except for vessels specifically authorized bodiescarrying out the protection of water living resources;
• fishing of marine mammals, fish and other water living resources listed in the Red Book of Ukraine;
• export (removal) of fish, crayfish and other water living resources in an amount exceeding the daily rate of fishing, or forbidden to fishing the rules of fisheries;
• seating from the Water, fishing tools belonging to other persons and fishing objects that are in these guns and the like;
• conducting without coordination with the bodies of fisheries and without the permission of the development of acclimatization (reactions), resettlement and breeding of new for the fauna of Ukraine or genetically aligned water living resources, rehabilitation of water bodies and the like.

Forbidden fishing of water living resources:

• with the use of explosives and poisonous substances, electric flow, stitching guns, firearms and pneumatic weapons (with the exception of cartoon rifles for underwater hunting), commercial and other fishing instruments made from nets and other materials of all types and items, as well as the method of juggling, facilities gay, dam and descent of water from fisheries reservoirs;
• in the channels of thermal power centers, submarine and reset channels of power plants;
• in the supply and mainstream channels, taps of fisheries and reclamation systems, in the sluzate channels like;
• in new reservoirs (up to a special order) with unregistered floating conditions or such that do not have a casual registration number (with the exception of rude boats);
• with boats or other plaques in industrial areas, enshrined for users of water living resources, as well as at a distance from the coast more than 3 km in the Black Sea and 1.5 km - in the Sea of \u200b\u200bAzov;
• in the upper beats of dams at a distance of 500 meters closer, in the lower - at a distance within the limits established by clause 4.13 of these fishery rules;
• near protected bridges, within the regime zones of guard;
• within a radius of 500 meters around the fish farms;
• in water bodies of fish and commodity fisheries;
• on water bodies located in the evacuation zone (alienation) in the territories, radioactively contaminated due to the disaster on Chernobyl nuclear power plant;
• in wintering pits;
• from ice on areas of water bodies, fixed behind fishing organizations - at a distance of more than 500 meters from the coast;
• on water bodies, not determined by fishewing bodies as those on which amateur fishing is allowed;
• at night (later than an hour from sunset and earlier than its sunrise) from boats and other floating funds in the Black and Azov seas;
• without the availability of relevant documents given the right to exercise a fishing in separate water bodies.

Implementation of amateur fishing

Amateur fishing and other water living resources is carried out:

• on common water bodies - free of charge;
• on the water bodies provided by public associations to organize amateur fishing:
• members of such associations - on their membership tickets;
• other citizens - by paid darling cards, which are issued by these associations. The cost of such cards is established by public associations in coordination with financial bodies Autonomous Republic of Crimea or the relevant area and with fishewing bodies;
• on water bodies where paid fishing, fishing from the shore, from boats or from ice - paid permissionswhich are issued by fishewing bodies.

The establishment of a fishing fee from the coast is allowed only on rivers, the area of \u200b\u200bthe catchment of which does not exceed 50 thousand square kilometers.

The right of free fishing on water bodies where paid fishing is introduced, as well as on those enshrined for public associations, provided (if there is an appropriate certificate):

• disabled I and II groups;
• participants in the elimination of the accident at the Chernobyl NPP I and II of categories, as well as children under 16.

Amateur fishing, other water living resources, with the exception of the species listed in clause 4.10 of the Rules of Fisheries, in the summer, in terms of the melting of ice and before the ice station (with the exception of the forbidden spawning period), is allowed:

• On public water bodies - from the shore or from a boat, rods of all kinds with a total number of hooks no more than five per fisherman and spinning.
• On the reservoirs where paid fishing are introduced: from the shore or with a boat rods of all kinds with a total of hooks no more than ten fishing and spinning.
• On the water bodies provided by public associations to organize amateur fishing:
  • members of public associations on their membership tickets from the shore and boats by rods of all kinds with a total number of hooks no more than ten fishing and spinning;
  • other persons are prohibited;
  • persons named in paragraph 4.1.2 of these Rules of Fisheries are entitled to free fishing from the shore and boat.

For children under 16, independent fishing is allowed only from the shore.

Amateur fishing in the winter period (from the ice-bedding before the opening of ice) is allowed by winter fishing rods with glitter vertical glittering with a crochet not more than N 10, frozen, huzzling and animal tackles with a total of hooks:

• on public water bodies, as well as those attached to public associations - no more than five fishing;
• on water bodies where paid fishing is installed - no more than ten fishing.

• on areas of water bodies defined by fishewing bodies for amateur fishing;
• in the presence of a certificate of an underwater hunter.

Underwater hunting is carried out with the obligatory compliance with the requirements of these fishery rules regarding the deadlines, the seats of fishing, the values \u200b\u200bof the catch, the availability of documents for the right of fishing, payment for permits and water living resources.

In the spawning forbidden period, amateur fisheries can be resolved by fishewed organs on specially defined areas of water bodies with one float or bottom fishing rod with one crochet and spinning from the shore.

Fishing invertebrates is allowed:

• all invertebrates - manual harvest, as well as:
• shrimps, hamarus, moth - with one pitch with a diameter of no more than 70 cm;
• moth - one manual drag with a diameter of no more than 70 cm without the use of mechanical devices;
• mussels, greened mollusk Rapane - Tongs, Sacred with a diameter of no more than 70 cm, underwater fishless without the use of scuba and other autonomous respiratory devices;
• cancer - Rakolovka- "Happo" with a diameter of no more than 70 cm and a cell of no more than 22 mm, a fishing line with bait and slingshot;
• "Roszchep" - no more than five tackles on the catcher.

It is forbidden to catch cancers in the spawning period, during molting and tooling the caviar, as well as in the dark (later than an hour from sunset and earlier than its sunrise) with the use of backlight.

7. Citizens who are engaged in amateur and sports fish are required:

7.1. comply with these rules and the fishery regime on the visited water (plot);

7.2. maintain the proper sanitary condition on the reservoirs, not to leave on the ice and shores of water bodies and other waste, not allow pollution and clogging of water bodies;

7.3. to have documents certifying the identity, members of the societies of hunters and fishermen - membership card; In cases where fishing on a water branch or a plot of water is carried out in permissions - to have permission with you;

7.4. Do not violate on water bodies and fishing and sports bases public order, assist the state inspections of fisheries in the detention of violators of these rules and the suppression of violations;

7.5. take care of the preservation of green springs on the shores of the reservoirs;

7.6. Do not allow damage and damage to pointers, shields, and other signs installed on the reservoir and on the shore.

8. Basin offices for the protection and reproduction of fish stocks and fishery regulation is given right in the prescribed manner:

8.1. To transfer the time of the ban on 10 days in accordance with the coordination with scientific fishery organizations, depending on the hydrometeorological conditions, without changing the total duration of the forbidden period.

8.4. establish a full or partial ban on fishing in water bodies or areas of water bodies where cultural fisheries are organized by hunters and fishermen societies;

8.5. In coordination with scientific fisheries, identify the boundaries of spawning sites and wintering pits, as well as the dates of the fishing of fish in the period of ice-bearing and ice breakdown.

9.1. Amateur and sports hunting for any marine beast everywhere and year-round;

9.2. produce without coordination with the Advisory Board of Acclimatization under the Ichtiological Commission and the permission of the fishering bodies, acclimatization, rehabilitation and breeding of new fish species;

9.3. Apply without the permission of the organs of fisheries, new gear and ownership methods not provided for by these Rules;

9.4. carry out fishing competitions during the spawning period;

9.5. located on a reservoir or in close proximity to it with fish guns, the use of which at this time is prohibited, as well as with explosives and poisoning substances;

9.6. sale of networks, fishing instruments and accessories to them, the use of which is prohibited by these Rules;

9.7. produce in the reservoirs washing vehicles (cars, motorcycles, etc.), as well as to produce work, negatively affecting the hydrochemical regime of water bodies;

9.8. Sale by individuals of valuable species of fish, marine, mammals and water invertebrates, for illegal catch, the production and destruction of which is provided for the recovery of damage from citizens (according to the approved taxation);

9.9. Stopping of floating rates within forbidden for fisheries, except for stopping in villages, cases of course (Storm, fog, accident, etc.).

10. Underwater fish hunt with the use of harpunov and harpudinous rifles is resolved without the use of scuba and other autonomous respiratory devices on sites, which are determined by the fishewed bodies.

11.1. with the use of explosives and poisoning substances, electric flow, stitching guns, firearms and pneumatic weapons (with the exception of rifles and pistols for underwater hunting), the method of crimson;

11.2. in the supplying mains and discharges of fisheries landflowing systems, as well as in the gateway channels;

11.3. to a special order in the newly formed reservoirs;

11.4. with unregistered floating conditions, as well as not having a clear number on the case;

11.5. on fishing sites (tones, floats, areas of installation of shutting guns, etc.);

11.6. Enterprises and organizations of the fishing industry, fishing collective farms and other fisheries organizations on water bodies or areas of water bodies, on which cultural fisheries of amateur and sports fisheries are organized by the societies of hunters and fishermen, except in cases where it is made upon proposal or with the consent of the relevant society.

12. The courts of a small fleet owned by citizens who are not subject to register supervision are registered in the manner prescribed in the region.

The movement of the ships of a small fleet can be temporarily prohibited in the prescribed manner or limited to the submission of fishewed organs.

13. Sampling from the WATER tools used in violation of these Rules, and the delivery of selected fishing guns, plastic and fish, and fish catches to the place of delivery is carried out by the violater at the request of the fishewed organs.

Amateur and sports fisheries

16. Amateur and sports fish are allowed:

17.4. In reservoirs, all the work provided for by plans for creating cultural fisheries, in accordance with the fisheries regime developed by society for this reservoir and coordinated with Mosrybvoda.

Note: until the end of work on the organization of cultural fisheries, fishing in these reservoirs is made in accordance with paragraph 17.3 of these Rules.
